Welcome to Quicksite, a service provided by Websoft Solutions (PTY) LTD. These terms outline the rules and regulations for the use of our websites and services.

By accessing this website, we assume you accept these terms and conditions in full.

The following terminology applies to these Terms and Conditions, and any or all Agreements: "Client," "You," and "Your" refers to you, the person accessing this website and accepting the Company's terms and conditions. "The Company," "Ourselves," "We," "Our," and "Us," refers to Websoft Solutions (PTY) LTD. "Party," "Parties," or "Us," refers to both the Client and ourselves, or either the Client or ourselves.

All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, prevailing law of South Africa.

Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

User Responsibilities: Users are responsible for complying with all applicable laws and regulations when using our services, and for maintaining the confidentiality of their account credentials.

Service Description: Quicksite provides comprehensive website solutions, specialising in the development, and management of single-page, multi-page, and e-commerce websites .

Governing Law: These terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of South Africa.

Limitation of Liability: To the extent permitted by law, Websoft Solutions (PTY) LTD shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or inability to use our services.

Intellectual Property: All intellectual property rights related to our services and content are owned by Websoft Solutions (PTY) LTD.

Termination Clause: Either party may terminate the agreement for any reason by providing written 30 day notice to the other party.Upon prior notice full outstanding payment must be made.

1. Ownership and License

All content and materials created by Quicksite, including but not limited to text, graphics, website name, code, images, and logos, are the intellectual property of Websoft Solutions (PTY) LTD, unless otherwise specified. These materials are protected by applicable copyright and trademark law.

Quicksite grants clients a non-exclusive, non-transferable license to use the websites and associated materials created by Quicksite solely for their intended purpose. This license includes the right to display and use the website for its intended business or personal use.

Ownership of the code, design, and other materials used in the websites remains with Websoft Solutions (PTY) LTD. Clients may not claim ownership or intellectual property rights over any part of the websites developed by Quicksite.

The domain name purchased for the website by the client belongs to the client and can be transferred or managed according to their preferences. However, the underlying code, design elements, and other proprietary materials developed by Quicksite remain the exclusive property of Websoft Solutions (PTY) LTD.

Any unauthorized use, reproduction, or distribution of these materials is strictly prohibited and may result in legal action.

2. No Warranties

Quicksite and its services are provided on an "as is" and "as available" basis without any representations or warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the services will be uninterrupted, timely, secure, or error-free, nor do we make any warranty as to the results that may be obtained from the use of the services or the accuracy or reliability of any information obtained through the services.

Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to Quicksite, or by anyone who may be informed of any of its contents.

3. Confidentiality

Quicksite and its users acknowledge that during the course of using our services, confidential information may be disclosed. Confidential information includes, but is not limited to, proprietary business information, trade secrets, customer data, and any other information that is marked or reasonably understood to be confidential.

Quicksite shall take reasonable measures to protect the confidentiality of user data and information, in accordance with applicable laws and regulations.

4. Pricing and Hosting

Monthly payments for Quicksite services start at R600 and may vary based on the client's specific needs and requirements.

Quicksite includes hosting services as part of the monthly payment, covering hosting costs up to R300 per month. If the website's hosting requirements exceed R300 per month due to increased traffic, storage needs, or other factors, the client will be responsible for the additional hosting costs.

If the client does not already have a domain name, purchasing and managing the domain falls under the client's responsibility. This includes initial domain purchase and all subsequent renewals to maintain ownership.

If payment for the monthly services is not received within 5 days of the billing date, Quicksite reserves the right to temporarily suspend the client's website until payment is made in full.

5. Indemnification

Clients agree to indemnify and hold Websoft Solutions (PTY) LTD harmless from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with their use of Quicksite's services or any breach of these terms.

6. Dispute Resolution

Any dispute or claim arising out of or in connection with these terms, including any non-contractual obligations, shall be resolved through arbitration in Johannesburg, South Africa, under the laws of South Africa.

7. Data Protection and Privacy

Data Protection: Websoft Solutions (PTY) LTD is committed to protecting the privacy and security of your personal data. We collect and use personal data in accordance with applicable data protection laws and regulations.

Use of Personal Data: We collect personal data necessary for the provision of Quicksite's services. This may include but is not limited to, name, email address, contact information, and payment details.

Encryption and Security: We encrypt all sensitive information to protect it from unauthorized access and use industry-standard security measures to safeguard your personal data.

Sharing of Personal Data: We do not sell, trade, or otherwise transfer your personal data to third parties without your consent, except as required by law or as necessary for the provision of our services.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

10. Governing Law and Jurisdiction

Governing Law and Jurisdiction: These terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of South Africa. The parties hereby submit to the exclusive jurisdiction of the courts of Johannesburg, South Africa, to resolve any disputes arising out of or relating to these terms.

11. Cancellation Policy

Cancellation: Clients may cancel their services with Quicksite by providing written notice at least 30 days prior to the desired cancellation date. No refunds will be provided for prepaid services.

12. Service Level Agreement (SLA)

Service Availability: Quicksite's services are available during regular business hours (Monday to Friday, 9:00 AM to 5:00 PM SAST). We strive to maintain our services uptime as much as possible, but occasional downtime for maintenance, upgrades, or unforeseen circumstances may occur.

Response Times: Response times for support requests and inquiries may vary based on the urgency and complexity of the issue. We aim to respond to all support requests within 1-2 business days.

Service Limitations: Quicksite reserves the right to impose limitations on service availability and functionality as necessary to maintain quality of service, security, and performance. These limitations may include scheduled maintenance periods, temporary suspensions due to security concerns, or upgrades to improve service.

Client Responsibilities: Clients are responsible for maintaining the confidentiality of their account credentials and for complying with all applicable laws and regulations when using our services.

13. User Conduct

User Conduct: Clients are expected to use Quicksite's services responsibly and in accordance with all applicable laws. Any use of our services that violates local, national, or international laws is strictly prohibited.

14. Accessibility

Accessibility: Quicksite is committed to ensuring our services are accessible to all users, including those with disabilities. We strive to comply with accessibility standards to provide an inclusive user experience.

15. Updates to Services

Service Updates: Quicksite may update its services from time to time, which may include adding or removing features, or modifying functionality. Clients will be notified of significant updates that may affect their service agreements.
